RE: The tariff classification of precious and semiprecious stones from Tanzania.

Dear Mr. Mgeni:

In your undated letter received by us on February 5, 2004, you requested a tariff classification ruling.

Your company is planning to export precious gemstones i.e. emeralds and rubies, and semiprecious gemstones i.e. amethyst, aquamarine and opal to the United States.

The applicable subheading for precious and semiprecious stones, if unworked, will be 7103.10.2000, Harmonized Tariff Schedule of the United States (HTS), which provides for “Precious stones (other than diamonds) and semiprecious stones, whether or not worked or graded but not strung, mounted or set; ungraded precious stones (other than diamonds) and semiprecious stones, temporarily strung for convenience of transport: Unworked or simply sawn or roughly shaped: Unworked.” The rate of duty will be free.

The applicable subheading for rubies, if worked, will be 7103.91.0010, HTS, which provides for “Precious stonesOtherwise workedRubies.” The rate of duty will be free.

The applicable subheading for emeralds, if worked, will be 7103.91.0030, HTS, which provides for “Precious stones Otherwise worked Emeralds.” The rate of duty will be free.

The applicable subheading for semiprecious stones, if worked, will be 7103.99.1000, HTS, which provides for “semiprecious stonesOtherwise worked: Other: Cut but not set, suitable for use in the manufacture of jewelry.” The rate of duty will be free.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
