RE: The tariff classification of jump ropes from China.

Dear Ms. Mosqueda:

In your letter dated September 3, 2003, you requested a tariff classification ruling.

You submitted a sample of a “Hot Rainbow 7ft. Jump Rope (3 Styles)” identified as assortment number 1995. The assortment consists of three jump ropes that measure approximately 7 feet in length with plastic handles. The first jump rope is made of green and purple braided cord and has purple handles. The second jump rope is made of braided cord that is colored in an alternating pattern of yellow, orange, blue, green, red, and purple and has green handles. The third jump rope is made of green, pink, yellow, orange, and purple plastic “links” and has yellow handles. Each jump rope is packaged in a plastic bag with an attached bright pink hangtag that indicates that the item is designed for a child four years of age and up. The construction, marketing and packaging of these jump ropes are indicative of the class or kind of jump ropes classifiable as toys in Heading 9503 of the Harmonized Tariff Schedule of the United States (HTS).

The applicable subheading for the “Hot Rainbow 7ft. Jump Rope (3 Styles)” identified as assortment number 1995 will be 9503.90.0080, Harmonized Tariff Schedule of the United States (HTS), which provides for “Other toys; reduced-size ("scale") models and similar recreational models, working or not; puzzles of all kinds; parts and accessories thereof: Other: Other.” The rate of duty will be free.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
