RE: The tariff classification of a scrubber and a scrubber pad refill from China.

Dear Mr. Laumann:

In your letter dated August 4, 2003, you requested a tariff classification ruling.

The samples submitted are a household scrubber and a scrubber pad refill. The scrubber is made of polypropylene nonwoven textile fabric with a plastic disc attached onto one side. It contains no abrasive material. The scrubber features a removable plastic handle. Printed onto the handle are the words “Scotch-Brite.”

The scrubber pad refill is constructed of polypropylene nonwoven textile fabric with a plastic disc attached onto one side. The plastic disc is designed with grooves to fit the reusable “Scotch-Brite” plastic handle.

You believed that the scrubber and the scrubber pad refill should be classified in subheading 9603.90.8050, Harmonized Tariff Schedule of the United States (HTS), which provides for brooms, brushes . . . Other brushes constituting parts of machines, appliances or vehicles, Other: Other, other. The scrubber is not a brush as it does not have bristles and therefore is not classified under 9603.90.8050.

The applicable subheading for the scrubber and scrubber pad refill will be 6307.90.9889, HTS, which provides for other made up articles . . . Other. The rate of duty will be 7 percent ad valorem.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
