RE: The tariff classification of women’s shirts from China

Dear Mr. Muhlfelder:

In your letter dated July 8, 2003 you requested a classification ruling on behalf of Shopka Stores, Inc.

The samples submitted for review, styles 3316713 and 3316714, are women’s shirts that are made from knit and woven fabric components. The back panel and sleeves of style 3316713 are constructed from 100 percent acrylic rib knitted fabric. The front panels are constructed from 100 percent cotton denim fabric. The garment features long sleeves, a faux fur collar, front yoke, chest pockets with button flaps, a full front opening secured by buttons and a banded bottom at the front. The back panel and sleeves of style 3316714 are constructed from 100 percent acrylic jacquard knitted fabric. The front panels and collar are constructed from 55 percent ramie and 45 percent cotton woven fabric. The garment features long sleeves, a shirt collar, front yoke, chest pockets with button flaps, a full front opening secured by buttons and a banded bottom at the front.

As noted above, the garments are made up of two different types of fabric. Such garments are considered a composite good, and based upon GRI 3(b) classified by the component that provides the essential character. In this case, because the entire front of both garments consists of woven fabric that is the component which imparts the essential character to the garment.

The applicable subheading for style 3316713 will be 6206.30.3010, Harmonized Tariff Schedule of the United States (HTS), which provides for women’s or girls’ blouses, shirts and shirt-blouses: of cotton: other: other, with two or more colors in the warp and/or the filling: women’s. The duty rate will be 15.5 percent ad valorem.

The applicable subheading for style 3316714 will be 6206.90.0040, Harmonized Tariff Schedule of the United States (HTS), which provides for women’s or girls’ blouses, shirts and shirt-blouses: of other textile materials, other. The duty rate will be 6.7 percent ad valorem.

Style 3316713 falls within textile category designation 341; style 3316714 falls within textile category designation 840. Based upon international textile trade agreements category 341 from China is subject to quota and the requirement of a visa.

The designated textile and apparel categories and their quota and visa status are the result of international agreements that are subject to frequent renegotiations and changes. To obtain the most current information, we suggest that you check, close to the time of shipment, the Textile Status Report for Absolute Quotas, which is available at our Web site at www.cbp.gov. In addition, the designated textile and apparel categories may be subdivided into parts. If so, visa and quota requirements applicable to the subject merchandise may be affected and should also be verified at the time of shipment.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
