RE: The tariff classification of a printer/copier from the Netherlands.

Dear Mr. Peterson:

In your letter dated June 20, 2003, on behalf of your client Xerox Corporation you requested a tariff classification ruling.

The merchandise under consideration is the Xerox WorkCentre Pro 320/315 Printer/Copier. The WorkCentre Pro is a desk top multifunction printer, copier and scanner measuring approximately 24.4 inches wide by 22 inches deep and is 15.5 inches high. As imported, this machine is an electrostatic laser printer designed to be used as a desktop printer with its IEEE 1284 port (included), network interface cards and connections are optional. This machine uses the Scan-Once-Print-Many technology allowing it to scan an original once and make multiple copies. From the Xerox literature supplied with your ruling request and a phone conversation with you, it has been determined that a toner cartridge containing the print mechanism is supplied with the WorkCentre Pro for installation after importation. When imported as the WorkCentre Pro 320 designation, this machine is capable of printing up to 20ppm (pages per minute). When imported as the WorkCentre Pro 315 designation, this machine is capable of printing up to 15ppm. The WorkCentre Pro 320/315 Printer/Copier has 16MB standard memory (expandable up to 128MB). Printer output resolution is 600 x 1800dpi (Dots Per Inch), copier and scanner output resolution is 600 x 600dpi with a zoom reduction-enlargement function from 50 to 200% in 1% increments plus five presents. A 500-sheet paper tray is standard.

The applicable subheading for the WorkCentre Pro 320/315 Printer/Copier will be 8471.60.6200, Harmonized Tariff Schedule of the United States (HTS), which provides for “Automatic data processing machines and units thereofInput or output units, whether or not containing storage units in the same housing: Other: Printer units: Other: Laser: Other.” The general rate of duty will be free.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
