RE: The tariff classification of “Fuzzy Lights” from China.

Dear Ms. Santos:

In your letter dated June 10, 2003, you requested a tariff classification ruling.

You are requesting the tariff classification on a product that is described as CVS item number 239845, “Fuzzy Lights”. The item is a plush bear with a plastic heart around its neck. When the paw of the bear is squeezed, the heart around its neck lights up. There is a metal chain with a clip-on ring attached to the head of the bear, so that the bear may be used on a backpack or on a belt loop. The item is not a functional key chain, and the proper classification will be in Chapter 95 of the HTS, as toys representing animals because of the whimsical nature of the bear. The sample will be returned, as requested.

The applicable subheading for the “Fuzzy Lights”, item number 239845, will be 9503.49.0000, Harmonized Tariff Schedule of the United States (HTS), which provides for toys representing animals or non-human creatures...and parts and accessories thereof: other. The rate of duty will be free.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
