RE: The tariff classification of dolls from China.

Dear Ms. Santos:

In your letter dated March 13, 2003, you requested a tariff classification ruling.

The sample submitted, Item #72688, Ga Ga Microbabies™ Assortment, consists of plastic hand painted battery operated interactive dolls that measure approximately 2-1/4 inches in height x 1-1/2 inches in length x 1 inch in thickness and are posed in seated positions. The dolls react to sound and touch, speak, vibrate, and display five levels of “emotion” (very happy, happy, normal, uncomfortable, and very uncomfortable). To activate the doll a child presses a pacifier located in the doll’s mouth, which places the doll in a “normal” emotional state. Gently pressing the pacifier and speaking to the doll with long soothing words keeps the doll “happy” and causes the doll to talk to the child in baby language. Conversely, uttering short, sharply spoken words or ignoring the doll entirely changes the doll’s mood to “uncomfortable” resulting in crying, screaming, and shaking. Gently pressing the pacifier and speaking softly to the doll will reverse the mood and cause the doll to become happy again. The doll can be de-activated by pressing the pacifier down for approximately five seconds. Three 1.5 volts batteries are required per doll, which are included.

The applicable subheading for Item #72688, Ga Ga Microbabies™ Assortment, will be 9502.10.0060, Harmonized Tariff Schedule of the United States (HTS), which provides for “Dolls representing only human beings and parts and accessories thereof: Dolls, whether or not dressedOther.” The rate of duty will be free.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
