RE: The tariff classification of a 3-game assortment from China

Dear Ms. Santos:

In your letter dated May 28, 2003, you requested a tariff classification ruling.

You are requesting the tariff classification on an item that is an assortment of 3 games that are used at Halloween. The three games together have one item number: 243623. One game is called a Spider Ring Toss: 1 inflatable spider and 4 plastic rings. The player tosses the rings onto the spider’s legs for points. The second game is a Pumpkin Bean Bag Toss with 1 inflatable pumpkin and 3 beanbags. The player tosses the beanbags into the pumpkin to score points. The last game is named Halloween Darts and it is comprised of a dartboard and 3 magnetic darts. All three games will be classified as games: the Halloween Darts game will be classified as games played on boards of a special design, while the other two games will be classified as games, other. The samples will be returned, as requested.

The applicable subheading for the Spider Ring Toss and the Pumpkin Bean Bag Toss, item number 243623, will be 9504.90.9080, Harmonized Tariff Schedule of the United States (HTS), which provides for articles for arcade, table or parlor games...parts and accessories thereof: other: other: other. The rate of duty will be free.

The applicable subheading for the Halloween Darts, item number 243623, will be 9504.90.6000, Harmonized Tariff Schedule of the United States (HTS), which provides for articles for arcade, table or parlor games...parts and accessories thereof: other: chess, checkers, parchisi, backgammon, darts and other games played on boards of a special design, all the foregoing games and parts thereof (including their boards)...poker chips and dice. The rate of duty will be free.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
