RE: The tariff classification of men’s knit and woven garments from Taiwan and Bangladesh

Dear Mr. Walton:

In your letter dated April 25, 2003, you requested a tariff classification ruling.

Style MH3CV1091 is a men’s garment that is constructed from 100 percent polyester, finely knit fabric that is brushed on the inside and outside surfaces. Style MH3CV1091 features a self-fabric stand-up collar; a full front opening with a zippered closure; long, hemmed sleeves; vertical, inset pockets below the waist; and a loose fitting, straight, hemmed bottom.

Style MH3CRB8054 is a men’s lined shirt that is constructed from a 100 percent cotton, woven fabric shell with a jersey knit lining. The shell fabric weighs 8 ounces per square yard. Style MH3CRB8054 has a spread collar, a full front opening with a left over right placket and six snap closures, long sleeves with a single snap at each cuff, two chest pockets with flaps and snap closures, and a straight, hemmed bottom with side vents.

The applicable subheading for Style MH3CV1091 will be 6110.30.3050, Harmonized Tariff Schedule of the United States, (HTS), which provides for: sweaters, pullovers, sweatshirts, waistcoats (vests) and similar articles, knitted or crocheted: of man-made fibers: other: other: other: other: men’s or boys’. The rate of duty will be 32.2 percent ad valorem.

The applicable subheading for Style MH3CRB8054 will be 6205.20.2065, Harmonized Tariff Schedule of the United States, (HTS), which provides for: men’s or boys’ shirts, of cotton: other: other: other: men’s. The rate of duty will be 19.8 percent ad valorem.

Style MH3CV1091 falls within textile category designation 638 and Style MH3CRB8054 falls within textile category designation 340. Based upon international textile trade agreements, products of Taiwan and Bangladesh are subject to visa requirements and quota restraints.

The designated textile and apparel categories and their quota and visa status are the result of international agreements that are subject to frequent renegotiations and changes. To obtain the most current information, we suggest that you check, close to the time of shipment, the Textile Status Report for Absolute Quotas, which is available at our Web site at www.cbp.gov. In addition, the designated textile and apparel categories may be subdivided into parts. If so, visa and quota requirements applicable to the subject merchandise may be affected and should also be verified at the time of shipment.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
