RE: The tariff classification of a textile/foam automotive headliner material, from Portugal.

Dear Mr. Warren:

In your letter dated March 28, 2003, on behalf of Borgstena Chatham, Mt. Airy, NC, which was a follow up to your earlier inquiry where we requested additional information, you requested a tariff classification ruling. The supplier is Raus, Antonio, Borgstena Textile, Nelas, Portugal.

This is a two-layer material which consists of a lightly brushed, warp knit fabric, of texturized polyester man-made fiber yarns, that has been laminated on one side with a cellular polyester plastics layer. The fabric portion will form the outer or exposed surface of the final product. You state that this material will be imported in rolls measuring 54 to 110 inches in length and from 56 to 107 inches in width. Finally, you indicate that this material will be imported in overall weights of from 75 g/m² to 120 g/m² with the backing surface varying from 28g/m² to 35 g/m², respectively.

The applicable subheading for the material will be 5903.90.2500, Harmonized Tariff Schedule of the United States (HTS), which provides for textile fabrics impregnated, coated, covered or laminated, with plastics, of man-made fibers, not over 70 percent by weight of plastics. The duty rate is 7.6 percent ad valorem.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
