RE: The tariff classification of a toy dress-up set from China.

Dear Ms. Price:

In your letter dated February 28, 2003, you requested a tariff classification ruling.

The submitted sample, Item #21880, identified in your ruling request as a Play N Pretty Mini Train Case Set and on its hangtag as a Play N Pretty Beauty Wear Hair Set, consists of 1 lipstick, 1 yellow flower-shaped hair clip decorated with glitter, 1 heart-shaped container with rouge, 1 flower-shaped container with rouge, 2 plastic flower-shaped rings, 1 bottle of nail polish, 1 toe separator, 1 heart-shaped mirror, and 6 vibrant colored hair ties decorated with glitter. These components are packaged in form-fitting indentations inside a removable inner pink sleeve that fits inside a pink train case decorated with glitter. All of the components contribute to the imitative role-play activity of dressing-up like a grown-up, and are put up in a manner indicating their use as a toy for the amusement of children.

The applicable subheading for the dress-up toy set of Item #21880 will be 9503.70.0000, HTS, which provides for “Other toys, put up in sets or outfits, and parts and accessories thereof.” The rate of duty will be free.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
