RE: The tariff classification of a radio-controlled mouse (an interactive pet toy) from China.

Dear Ms. Montante:

In your letter dated February 5, 2003, you requested a tariff classification ruling, on behalf of Ethical Products, your client.

You are requesting the tariff classification on a product that is described as a radio- controlled toy mouse, an interactive pet toy. The toy is a representation of a mouse on wheels and is operated in the same manner as a radio-controlled racecar. Although the toy will be used to amuse a pet who will chase the toy mouse, since the toy is operated by a child or adult it will also serve to amuse the person using the toy with the pet. As the foregoing sentence illustrates, the toy is truly interactive. The proper classification of the item will be in Chapter 95 of the HTS as other toys representing animals. The sample will be returned, as requested by your office.

The applicable subheading for the radio-controlled mouse (interactive pet toy) will be 9503.49.0000, Harmonized Tariff Schedule of the United States (HTS), which provides for toys representing animals or non-human creaturesand parts and accessories thereof: other. The rate of duty will be free.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
