RE: The tariff classification of a tool roll of sheeting of plastic from Mexico

Dear Mr. Lynch:

In your letter dated December 30,2002, you requested a tariff classification ruling. The request is on behalf of Velcro USA Inc.

A sample of part number 256875, tool holder has been submitted. It is wholly made up of imitation leather and has hook and loop type fasteners. The imitation leather is composed of an exterior surface of embossed polyurethane plastic sheeting and a backing of non-woven fabric. It is fitted to hold an auto mobile lug wrench and lift of the kind used to change an automobile tire. Part number 256875, tool holder, is of a kind similar to a tool roll which is an eo nomine article of heading 4202, Harmonized Tariff System of the United States (HTSUS).

The applicable subheading for the tool holder, part 256875, will be 4202.92.9060, Harmonized Tariff Schedule of the United States (HTS), which provides for other containers and cases, with outer surface of sheeting of plastic or of textile, other, other. The rate of duty will be 17.8 percent ad valorem.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
