RE: The tariff classification of women's wearing apparel from Vietnam

Dear Mr. Garrett:

In your letter dated December 6, 2002, you requested a ruling on tariff classification. The samples submitted with your request will be returned to you under separate cover.

Style 85595 is a pair of women’s pants constructed from 100 percent cotton woven fabric. The pants feature an elasticized drawstring waist and capri length legs. The pants have an embroidered design on the back right hip and on the front pant legs.

Style 85360 is a woman’s blouse constructed from 100 percent cotton woven fabric. The blouse is sleeveless and features a V-neckline, an elasticized drawstring waist, side vents and measures 3 ½ inches at the shoulder seam.

Style 85597 is a woman’s blouse constructed from 100 percent cotton woven fabric. The is sleeveless and features a drawstring neckline, side vents, embroidered design around the bottom and measures one inch at the shoulder seam.

Style 85598 is a woman’s blouse constructed from100 percent cotton woven fabric. The pullover blouse features a round neckline with a partial opening, long sleeves with vents and side vents. The blouse is embellished with embroidery around the sleeve edges, front neckline and center back neck.

Style 85367 is a woman’s upper body garment constructed from 95 percent cotton and 5 percent spandex woven fabric. The pullover garment is sleeveless and features a round neckline, side vents and embroidery around the bottom.

The applicable subheading for style 85595 will be 6204.62.4020, Harmonized tariff Schedule of the United States (HTS), which provides for women’s or girls’ suits, ensembles, suit-type jackets, blazers, dresses, skirts, divided skirts, trousers, bib and brace overalls, breeches and shorts (other than swimwear): trousers, bib and brace overalls, breeches and shorts: of cotton: other: other: trousers and breeches: women’s: other. The rate of duty will be 16.8 percent ad valorem. Effective January 1, 2003, the rate of duty will be 16.7 percent ad valorem..

The applicable subheading for styles 85360 and 85598 will be 6206.30.3030, Harmonized Tariff Schedule of the United States (HTS), which provides for women’s or girls’ blouses, shirts and shirt-blouses: of cotton: other: other: other: women’s. The rate of duty will be 15.6 percent ad valorem. Effective January 1, 2003, the rate of duty will be 15.5 percent ad valorem.

The applicable subheading for style 85597 will be 6211.42.0056, Harmonized Tariff Schedule of the United States (HTS), which provides for track suits, ski-suits and swimwear; other garments: other garments, women’s or girls’: of cotton: blouses, shirts and shirt-blouses, sleeveless tank styles and similar upper body garment excluded from heading 6206: other. The rate of duty will be 8.2 percent ad valorem. Effective January 1, 2003, the rate of duty remains unchanged.

The applicable subheading for style 85367 will be 6110.20.2075, Harmonized tariff Schedule of the United States (HTS), which provides for sweaters, pullovers, sweatshirts, waistcoats (vests) and similar articles, knitted or crocheted: of cotton: other: other: women’s or girls’. The rate of duty will be 17.3 percent ad valorem. Effective January 1, 2003, will be 16.9 percent ad valorem.

Style 85595 falls within textile category designation 348; styles 85360, 85597 and 85598 fall within textile category designation 341 and style 85367 falls within textile category designation 339. Based upon international textile trade agreements products of Vietnam are currently not subject to quota restraints or the requirement of a visa.

The designated textile and apparel categories and their quota and visa status are the result of international agreements that are subject to frequent renegotiations and changes. To obtain the most current information, we suggest that you check, close to the time of shipment, the U.S. Customs Service Textile Status Report, an internal issuance of the U.S. Customs Service, which is available at the Customs Web site at www.customs.gov. In addition, the designated textile and apparel categories may be subdivided into parts. If so, visa and quota requirements applicable to the subject merchandise may be affected and should also be verified at the time of shipment.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R.177).
