RE: The tariff classification of shade netting from India or South Korea.

Dear Mr. Toprani:

In your letter dated November 5, 2002, you requested a ruling on tariff classification.

You sent a sample of a product you call Shade Netting. You describe it as high density polyethylene (HDPE) rachel knitted fabric; in a follow-up telephone call you stated that the fabric will be imported on rolls and will be hemmed on all four sides. The item will come in four sizes: 12’ x 1500’, 10’ x 500’, 6’ x 50’, and 3’ x 25’. It can be ordered in various colors, such as black, white, green, etc. It is UV stabilized and can be made to offer shade from 20% to 90%. It is used to provide shade for agriculture, public areas, or parking lots. It has holes at the edges where poles can be inserted.

The applicable subheading for this product will be 6307.90.9889, Harmonized Tariff Schedule of the United States (HTS), which provides for other made up textile articles, other. The general rate of duty will be seven percent ad valorem.

Articles classifiable under subheading 6307.90.9889, HTS, which are products of India are currently entitled to duty free treatment under the Generalized System of Preferences (GSP) upon compliance with all applicable regulations. The GSP, however, is subject to modification and periodic suspension, which may affect the status of your transaction at the time of entry for consumption or withdrawal from warehouse. To obtain current information on GSP, check the Customs Web site at www.customs.gov. At the Web site, click on “CEBB” and then search for the term “GSP”.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R.177).
