RE: The tariff classification of fishing gloves from China

Dear Mr. Ashizawa:

In your letter dated September 12, 2002, on behalf of L. S. Kei you requested a tariff classification ruling.

The submitted sample, style SNG-0211 is a glove constructed of two-plies of man-made fiber fleece with a plastic barrier sandwiched in the middle. The glove features irregular shaped synthetic leather overlays on the palm, heel and on the middle, ring and pinky fingertips. The tips of the index and thumb are exposed. Additional features include a fully elasticized wrist and a four -inch neoprene gauntlet cuff with a hook and loop fabric tab closure. The cumulation of features indicates a design for use in the sport of fishing.

The applicable subheading for the glove will be 6116.10.0800, Harmonized Tariff Schedule of the United States (HTS), which provides for Gloves, mittens and mitts, knitted or crocheted: impregnated, coated or covered with plastics or rubber: other gloves, mittens and mitts, all the foregoing specially designed for use in sports, including ski and snowmobile gloves, mittens and mitts. The rate of duty will be 3.3 percent ad valorem.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
