RE: The tariff classification of men’s and women’s shirts from Bangladesh and Myanmar/Burma

Dear Ms. Lai:

In your letter dated September 23, 2002, you requested a classification ruling.

You submitted three samples of garments, two men’s shirts and one woman’s shirt. These samples will be returned as you have requested.

In a telephone conversation you stated that the shirts will be sized using letter sizes “S”, “M” “L”, etc. You also stated that the shirts will be imported in three colors, white, blue and khaki. They will all have the same style number. You have provided either garments or swatches of all the colors involved. Because the different colored yarns do affect the classification, but not the corresponding textile category designation, for purposes of clarity in this ruling, where necessary, we will refer to the styles with the letter suffixes “W”, “B” and “K” to indicate white, blue and khaki. The blue and khaki styles of all the garments feature a colored yarn in the warp and a white yarn in the filling. These are not to be misconstrued as the actual style numbers. Those style identifiers consist only of five numbers with no letter suffix.

Style 87007 is a men’s 70 percent cotton and 30 percent polyester woven fabric shirt. The shirt features a full left over right front opening secured by seven buttons, long sleeves with buttoned cuffs, a button-down collar, a left chest pocket, two back pleats extending from the yoke and a curved hemmed bottom.

Style 87008 is a men’s 70 percent cotton and 30 percent polyester woven fabric shirt. The shirt features a full left over right front opening secured by seven buttons, short sleeves, a button-down collar, a left chest pocket, two back pleats extending from the yoke and a curved hemmed bottom.

Style 77004 is a woman’s 70 percent cotton and 30 percent polyester woven fabric shirt. The shirt features a full left over right front opening secured by seven buttons, long sleeves with buttoned cuffs, a button-down collar, two back pleats extending from the yoke and a curved hemmed bottom.

The applicable subheading for styles 87007(B), 87007(K), 87008(B) and 87008(K) will be 6205.20.2050, Harmonized Tariff Schedule of the United States (HTS), which provides for men’s or boys’ shirts, of cotton, other, other, other, with two or more colors in the warp and/or the filling, other, men’s. The duty rate will be 20 percent ad valorem.

The applicable subheading for style 87007(W) and 87008(W) will be 6205.20.2065, HTS, which provides for men’s or boys’ shirts, of cotton, other, other, other, other, men’s. The duty rate will be 20 percent ad valorem.

The applicable subheading for styles 77004(B) and 77004(K) will be 6206.30.3010, HTS, which provides for women’s or girls’ blouses, shirts and shirt-blouses, of cotton, other, other, with two or more colors in the warp and/or the filling, women’s. The duty rate will be 15.6 percent ad valorem.

The applicable subheading for style 77004W will be 6206.30.3040, HTS, which provides for women’s or girls’ blouses, shirts and shirt-blouses, of cotton, other, other, other, women’s. The duty rate will be 15.6 percent ad valorem.

Styles 87007 and 87008 fall within textile category designation 340. Style 77004 falls within textile category designation 341. Based upon international textile trade agreements products of Bangladesh, categories 340 and 341, are subject to quota and the requirement of a visa. Based upon international textile agreements products of Myanmar/Burma, category 340, are subject to quota but do not require a visa. Based upon international textile agreements, products of Myanmar/Burma, category 341, are not subject to quota and do not require a visa.

The designated textile and apparel categories and their quota and visa status are the result of international agreements that are subject to frequent renegotiations and changes. To obtain the most current information, we suggest that you check, close to the time of shipment, the U.S. Customs Service Textile Status Report, an internal issuance of the U.S. Customs Service, which is available at the Customs Web site at www.customs.gov. In addition, the designated textile and apparel categories may be subdivided into parts. If so, visa and quota requirements applicable to the subject merchandise may be affected and should also be verified at the time of shipment.

For your information merchandise from Myanmar/Burma must be marked for country of origin purposes with “Burma”, “Burma/Myanmar” or “Myanmar/Burma” to satisfy the requirements of 19 UCS 1304.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
