RE: The tariff classification of down jackets from China.

Dear Ms. Whitehead:

In your letter dated August 26, 2002, on behalf of Calvin Klein Jeans, you requested a classification ruling. The samples will be returned to you as requested.

The submitted samples, styles ZJBB40611 and ZD50P0260 are women’s jackets composed of woven polyester fabric filled with down and water fowl plumage. Style ZJBB40611 is filled with 75% down/25% feathers, down weight 210 grams, garment weight 650 grams. Style ZD50P0260 is fill with 80% down/20% feathers, down weight is 250 grams, garment weight 600 grams. Style ZJBB40611 has a full front zipper closure, a large mock turtle neck collar and two slash pockets. Style ZD50P0260 features a full length zipper closure, stand-up collar and two slash pockets.

The applicable subheading for styles ZJBB40611 and ZD50P0260 will be 6202.93.1000, Harmonized Tariff Schedule of the United States (HTS), which provides for “Women’s or girls’windbreakers and similar articlesOf man-made fibers: Containing 15 percent or more by weight of down and waterfowl plumage and of which down comprises 35 percent or more by weight; containing 10 percent or more by weight of down.” The duty rate will be 4.5% ad valorem and the textile category is 654.

China is a member of the World Trade Organization (WTO), and the down jackets are not subject to quota or the requirements of a visa.

The designated textile and apparel categories and their quota and visa status are the result of international agreements that are subject to frequent renegotiations and changes. To obtain the most current information, we suggest that you check, close to the time of shipment, the U.S. Customs Service Textile Status Report, an internal issuance of the U.S. Customs Service, which is available at the Customs Web site at www.customs.gov. In addition, the designated textile and apparel categories may be subdivided into parts. If so, visa and quota requirements applicable to the subject merchandise may be affected and should also be verified at the time of shipment.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
