RE: The tariff classification of travel cases for cosmetics from China

Dear Ms. Kwok:

In your letter dated August 9th, 2002 you requested a tariff classification ruling.

The sample submitted, identified as Style# C-69883B, is a 100 per cent woven polyester travel case for cosmetics. It measures approximately 6 ½”W x 3 ½”H x 2 ½”D. The bag has two zippered compartments, both of them with open pockets and fitted holders to accommodate cosmetics, brushes, and other items. The bag also has two matching carrying straps.

The applicable subheading for the cases will be 4202.12.8070, Harmonized Tariff Schedule of the United States (HTS), which provides for trunks, suitcaseswith outer surface of plastics or of textile materialsof man-made fibers. The rate of duty will be 18.1 per cent ad valorem. You have asked whether this product is subject to antidumping duties or countervailing duties. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
