RE: The tariff classification of a candle gift set from China

Dear Ms. Rudd:

In your letter dated August 7, 2002, you requested a tariff classification ruling. The submitted sample will be returned as requested.

The article, style number GFF364-3, consists of three glass candleholders with three tea light candles and purple flowers in each holder. The article is classified as a set with the candleholders imparting the essential character.

The applicable subheading for the candle gift set, style number GFF364-3, will be 9405.50.4000, Harmonized Tariff Schedule of the United States (HTS), which provides for other non-electrical lamps and lighting fittings, other. The rate of duty will be 6 percent ad valorem.

This article may be subject to antidumping duties (AD) or countervailing duties (CVD).
