RE: The tariff classification of a colorimeter for calibrating monitors from Hong Kong and China.

Dear Mr. Gerard:

In your letter dated July 30, 2002, you requested a tariff classification ruling.

The merchandise under consideration is known as the Pantone ColorVision “Spyder.” A sample was submitted with your ruling request. The Spyder is a digital colorimeter with a spectral range of 400-700 nanometers. It is used for calibrating monitors to provide accurate and consistent color quality.

The Spyder consists of a disc approximately three inches in diameter encased within a triangular plastic frame with suction cups and a permanently attached USB (Universal Serial Bus) cable. When the Spyder is plugged into a computer’s USB port and used in conjunction with selected software, the user is guided through an on screen step-by-step process to provide precise color in the widest gamut the monitor is capable of producing. When prompted, you attach the Spyder to your screen by using the three-suction cups on the housing. It automatically adjusts your monitor’s luminance and measures and balances its RGB (Red Green Blue) guns. The monitor is now calibrated to your selected standards and an ICC (International Color Consortium) profile is created. The literature provided with your request indicates that the submitted sample, assembled without software, is identical to the item that will be imported.

The applicable subheading for the Pantone ColorVision “Spyder” will be 9027.50.4060, Harmonized Tariff Schedule of the United States (HTS), which provides for instruments and apparatus for physical or chemical analysis, other instruments and apparatus using optical radiations (ultraviolet, visible, infrared), electrical, other. The rate of duty will be free.

The sample of the Spyder is being returned to you as requested.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
