RE: The tariff classification of three toys called “Tickle Tickle Wiggle Wiggle” from China.

Dear Ms. Santos:

In your letter dated July 11, 2002, you requested a tariff classification ruling.

You are requesting the tariff classification on CVS item number 187040, comprised of three styles of tickle wiggle toy animals. There is a red tickle wiggle wearing a Santa hat. When the hand is pressed, the toy wiggles, sings a Christmas song and says “Happy Holidays”. The second toy is a white tickle wiggle wearing a snowman’s hat that wiggles, sings “Let It Snow” and says “Happy Holidays”, when one presses the snowman’s hand. The last of the tickle wiggle toys is brown in color, has reindeer ears, a Santa hat, and wiggles, sings “Sleigh Ride” and says “Happy Holidays” when its hand is pressed. The item, in all three styles, will be classified in Chapter 95 of the HTSUSA as other toys representing animals. The samples will be returned, as requested.

The applicable subheading for the three styles of item number 187040 (the tickle wiggle toys) will be 9503.49.0000, Harmonized Tariff Schedule of the United States (HTS), which provides for “Toys representing animals or non-human creatures (for example, robots and monsters) and parts and accessories thereof: Other.” The rate of duty will be free.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
