RE: The tariff classification of pet carriers from China

Dear Ms. Montante:

In your letter dated June 25th, 2002 you requested a tariff classification ruling. The request is on behalf of Ethical Products, Inc.

The first sample submitted is identified as a “Small EVA Foam Pet Carrier”. The carrier measures approximately 15”W x 10”H x 9”D. The main body of the item is constructed of EVA foam, wholly covered with a man-made textile material. Both ends and one of the sides feature open mesh panels designed for aeration. The other side has a zippered pocket. A top flap is secured by twin zippers that run the length of the top of the bag. One of the ends of the carrier is secured by a three sided zipper enclosure. The carrier also has two nylon webbed carrying straps. The inside of the carrier is lined.

The second sample submitted is identified as a “Large EVA Foam Pet Carrier”. The carrier measures approximately 16”W x 11”H x 8”D. The main body of the item is constructed of EVA foam wholly covered with a man-made textile material. One end of the carrier consists of an open mesh panel secured by a three- sided zipper. The upper half of the other end of the carrier is made of the same open mesh material. One side of the item features a box pocket that is secured by a velcro flap and the top has a zippered open mesh “window”. The other side has two adjustable shoulder straps. The carrier also has twin nylon webbed carrying straps on the top. The inside of the carrier is lined and has three removable rigid inserts that provide shape to the carrier.

Both samples will be returned as requested.

The applicable subheading for the pet carriers will be 4202.92.9026, Harmonized Tariff Schedule of the United States (HTS), which provides, in part, for other containers, with outer surface of textile materials or of sheeting of plastics, other. The rate of duty will be 18.1 per cent ad valorem.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
