RE: The tariff classification of the “Praying Angel Girl”, item # 928856, from China.

Dear Ms. Aldinger:

In your letter dated May 20, 2002, you requested a tariff classification ruling.

You are requesting the tariff classification on a product that is described as “Praying Angel Girl-12 inch”, item # 928856. The item is a battery operated kneeling angel dressed in a white lace dress with silver ribbon at the waist. When the activation point on the left wrist is depressed the angel sings “Silent Night”. Her hands move to give the appearance of praying and the eyes blink open and shut. The retail packaging identifies the product as The Little Christmas Angel. The article will be classified in Chapter 95 of the HTSUSA as a Christmas ornament. You have not requested the return of your sample.

The applicable subheading for the “Praying Angel Girl”, item # 928856, will be 9505.10.2500, Harmonized Tariff Schedule of the United States (HTS), which provides for “Festive, carnival or other entertainment articlesparts and accessories thereof: Christmas ornaments: Other.” The rate of duty will be free.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
