RE: The tariff classification of two stitch-bonded fabrics from Italy.

Dear Mr. Raponi:

In your letter dated April 30, 2002 you requested a tariff classification ruling.

Two samples of stitch-bonded fabric accompanied your request for a ruling. The first, designated as style Light Spring Dyed, is a dyed stitch-bonded fabric composed of 100% polyester fiber that has been formed into a nonwoven fabric and stabilized by rows of chain stitches composed of filament polyester yarns. Weighing 100 g/m2, this fabric will be imported in 208 centimeter widths. The second sample, designated as Light Spring Printed, is a printed stitch-bonded fabric of identical fiber content and construction and differs from the above described fabric in that it has been printed. Your correspondence indicates that both fabrics will be used in bedding industry in the manufacture of box springs.

The applicable subheading for the stitch-bonded fabric designated as style Spring Light Dyed will be 6005.32.0020, Harmonized Tariff Schedule of the United States (HTS), which provides for warp knit fabrics (including those made on galloon knitting machines), other than those of headings 6001 to 6004, of synthetic fibers, dyed, other, stitch-bonded goods. The rate of duty will be 10.8 percent ad valorem.

The applicable subheading for the stitch-bonded fabric designated as style Spring Light Printed will be 6005.34.0020, Harmonized Tariff Schedule of the United States (HTS), which provides for warp knit fabrics (including those made on galloon knitting machines), other than those of headings 6001 to 6004, of synthetic fibers, printed, other, stitch-bonded goods. The rate of duty will be 10.8 percent ad valorem.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
