RE: The tariff classification of a mitt from China.

Dear Mr. Liu:

In your letter dated May 2, 2002, you requested a tariff classification ruling on behalf of Coopsport International LP.

The submitted sample, Style 11071 Wetglove, is a waterproof three-fingered baseball mitt constructed of six-millimeter thick neoprene which is sandwiched between two finely knitted fabrics. The mitt features a ball pocket sewn between the thumb and forefinger and a woven textile wrist strap which is secured by hook and loop fasteners on the backside. Style 11071 will be sold in assorted colors. The mitt will also be available with a Hawaiian floral design as style 11079.

The applicable subheading for styles 11071 and 11079 will be 6116.10.0800, HTS, which provides for Gloves, mittens and mitts, knitted or crocheted: impregnated, coated or covered with plastics or rubber: other gloves, mittens and mitts, all the foregoing specially designed for use in sports, including ski and snowmobile gloves, mittens and mitts. The rate of duty will be 3.3 percent ad valorem.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
