RE: The tariff classification of three pair of women’s knit pajamas from Indonesia.

Dear Ms. Buckman:

In your letter dated February 6, 2002, you requested a classification ruling for three pair of women’s pajamas. The items are being returned as you requested..

Style 2368F2 is a pair of woman’s pajamas constructed from 75 percent polyester, 25 percent viscose knit fabric. The pajama tops have a boat neckline, long sleeves, and an overlock finished bottom. The pajama bottoms have an elasticized and drawstring waistband and overlock finished leg openings.

Style 2339F2 is a pair of woman’s pajamas constructed from 100 percent polyester knit fabric. The pajama tops have a shirt collar; a full front opening with satin covered button closure; long sleeves and a plan, hemmed bottom. The back of the collar and placket are trimmed with satin fabric. The pajama bottoms have an elasticized waistband and hemmed leg openings.

Style 2301F2 is a pair of woman’s pajamas constructed from 100 percent polyester knit fabric. The pajama tops have a neckline with a v opening and drawstring closure; a chest pocket, long sleeves, and a plan, hemmed bottom. The pajama bottoms have an elasticized waistband and hemmed leg openings.

The applicable subheading for styles 2368F2, 2339F2, and 2301F2 will be 6108.32.0010, Harmonized Tariff Schedule of the United States (HTS), which provides for Women’sPajamas , knitted or crocheted: Of man-made fibers. The duty rate will be 16.2 percent ad valorem.

Styles 2368F2, 2339F2, and 2301F2 fall within textile category designation 651. Based upon international textile trade agreements products of Indonesia are subject to quota and the requirement of a visa.

The designated textile and apparel categories and their quota and visa status are the result of international agreements that are subject to frequent renegotiations and changes. To obtain the most current information, we suggest that you check, close to the time of shipment, the U.S. Customs Service Textile Status Report, an internal issuance of the U.S. Customs Service, which is available at the Customs Web site at www.customs.gov. In addition, the designated textile and apparel categories may be subdivided into parts. If so, visa and quota requirements applicable to the subject merchandise may be affected and should also be verified at the time of shipment.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
