RE: The tariff classification of a women’s woven upper body garment from Hong Kong

Dear Mr. Travis:

In your letter dated December 21, 2001 on behalf of Tillsonburg Resources Asia, Ltd., you requested a classification ruling. The sample submitted with your request will be returned to you under separate cover.

Style 97E1865 is a women’s woven camisole made from 100 percent cotton sheer fabric. The garment extends to below the waist and features an empire style front, a V-neckline with a ribbon tie drawstring that draws the V-neck portion of the bust tighter and ¼ inch polyester ribbon shoulder straps. The front also features a 1½ inch self ruffle with nylon openwork fabric on top of the ruffle set at the neckline. The bust portion of the garment is constructed with a double layer of self-fabric. The back of the garment is cut straight across the top edge. There is slight shirring along the upper portion of the back, and a concealed zipper at the wearer’s left side.

The applicable subheading for style 97E1865 will be 6211.42.0081, Harmonized Tariff Schedule of the United States (HTS), which provides for other women’s garments. The duty rate will be 8.2 percent ad valorem.

Style 97E1865 falls within textile category designation 359. Based upon international textile trade agreements products of Hong Kong are subject to quota and the requirement of a visa.

The designated textile and apparel categories and their quota and visa status are the result of international agreements that are subject to frequent renegotiations and changes. To obtain the most current information, we suggest that you check, close to the time of shipment, the U.S. Customs Service Textile Status Report, an internal issuance of the U.S. Customs Service, which is available at the Customs Web site at www.customs.gov. In addition, the designated textile and apparel categories may be subdivided into parts. If so, visa and quota requirements applicable to the subject merchandise may be affected and should also be verified at the time of shipment.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
