RE: The tariff classification of a woman’s dress and cardigan from Pakistan.

Dear Ms. Prendergast:

In your letter dated December 18, 2001, you requested a classification ruling. As requested, your sample is being returned to you.

Your sample, style CS430, is a two piece garment comprised of a woman’s dress and a woman’s cardigan. The dress is constructed from 100% cotton knit fabric. It features short hemmed sleeves, a round neckline, and a hemmed bottom. The dress extends from the shoulder to the ankle area. The cardigan is constructed of 100% cotton knit fabric. The outer surface of the cardigan measures more than nine stitches per two centimeters in the horizontal direction. It features long hemmed sleeves, a one button full front opening, and a hemmed bottom.

The applicable subheading for the woman’s dress will be 6104.42.0020, Harmonized Tariff Schedule of the United States (HTS), which provides for women’s dresses, knitted: of cotton: women’s. The duty rate will be 11.6% ad valorem. The applicable subheading for the woman’s cardigan is 6110.20.2075, Harmonized Tariff Schedule of the United States (HTS), which provides for sweaters, pullovers, sweatshirts, waistcoats (vests) and similar articles, knitted or crocheted: of cotton: other: other. The duty rate will be 17.3% ad valorem.

The dress falls within textile category designation 336. The cardigan falls within textile category designation 339. Based upon international textile trade agreements, products from Pakistan are subject to quota and require a visa.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
