RE: The tariff classification of a Christmas tree skirt from India.

Dear Ms. Miller:

In your letter dated July 11, 2001, you requested a tariff classification ruling.

The submitted sample is a Christmas tree skirt. This Christmas tree skirt measures 57 inches in diameter. There are two sets of woven cord for tying the opening of the Christmas tree skirt together. It is composed of blue rayon velvet fabric with embroidered silver snowflakes. The Christmas tree skirt is trimmed with silver and blue around the border with matching tassels. Your letter of inquiry states that this product will be sold only during the months before Christmas and will not be sold after December 24th.

The sample is returned as you requested.

The applicable subheading for the Christmas tree skirt, will be 9505.10.2500, Harmonized Tariff Schedule of the United States (HTS), which provides for articles for Christmas festivities and parts and accessories thereof: Christmas ornaments: other, other. The rate of duty will be free.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
