RE: The tariff classification of women's sleep separates from Turkey or Bangladesh

Dear Mr. Bodek:

In your letter dated June 15, 2001, you requested a tariff classification ruling on behalf of Parthenon Sportswear, Ltd. The sample submitted with your request will be returned to you under separate cover.

Styles 5709/4708/6700/6701/6702 are women’s sleep bottoms constructed from 100 percent cotton woven fabric. The styles indicate differing fabric prints that will be used on the same basic body. The pull-on bottom features an elasticized waist drawstring waist and long hemmed legs.

You have indicated that these garments will be sold in the sleepwear department of retail stores. Based both on the appearance of the garments, as well as the manner in which they will be merchandised, these items are considered sleepwear.

The applicable subheading for the pajama bottoms will be 6208.91.3010, Harmonized Tariff Schedule of the United States (HTS), which provides for other women’s or girls’ sleep separates: of cotton. The rate of duty will be 11.4 percent ad valorem.

These garments fall within textile category designation 352. Based upon international textile trade agreements products of Turkey and Bangladesh are currently subject to quota restraints and the requirement of a visa.

The designated textile and apparel categories and their quota and visa status are the result of international agreements that are subject to frequent renegotiations and changes. To obtain the most current information, we suggest that you check, close to the time of shipment, the U.S. Customs Service Textile Status Report, an internal issuance of the U.S. Customs Service, which is available at the Customs Web site at www.customs.gov. In addition, the designated textile and apparel categories may be subdivided into parts. If so, visa and quota requirements applicable to the subject merchandise may be affected and should also be verified at the time of shipment.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R.177).
