RE: The tariff classification of polypropylene yarn from Switzerland.

Dear Mr. Morelli:

In your letter dated May 23, 2001, you requested a ruling on tariff classification.

You submitted polypropylene yarn, fibrillated, which you state to be about 1000-1200 denier. You call it polypropylene ribbon yarn. In its imported condition it is of a width not exceeding 5mm, which meets the tariff definition of textile. The yarn is on a tube weighing between two and three pounds. You state that you will weave this yarn principally for wallcoverings.

The applicable subheading for this product will be 5404.90.0000, Harmonized Tariff Schedule of the United States (HTS), which provides for synthetic monofilament...; strip and the like (for example, artificial straw) of synthetic textile materials of an apparent width not exceeding 5mm. The general rate of duty will be 1.5 percent ad valorem.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R.177).
