RE: The tariff classification of a toy dress-up set from China or Taiwan

Dear Ms. Denny:

In your letter dated May 30, 2001, you requested a tariff classification ruling.

The submitted article is called a “Toy Glamour Set”, item number 22112. The set consists of a plush purse, sunglasses, mirror, comb, bracelets, and body glitter pots. The articles are packaged together in an open window box for ages 6 and up. All the articles contribute to the role-play activity of dressing up like a fancy lady. The product is put up in a manner indicating its use as a toy for children’s amusement. Your sample is being returned as requested.

The applicable subheading for the “Toy Glamour Set” will be 9503.70.0000, Harmonized Tariff Schedule of the United States (HTS), which provides for other toys, put up in sets or outfits, and parts and accessories thereof. The rate of duty will be free.

Furthermore, you are advised that the body glitter pots are subject to the requirements of the Federal Food, Drug, and Cosmetic Act, which is administered by the U.S. Food and Drug Administration.
