RE: The tariff classification of wedding ring pillow from China.

Dear Ms. O’Dell:

In your letter dated May 23, 2001, you requested a tariff classification ruling.

The sample submitted is a wedding ring pillow made with an outer shell of woven textile fabric with polyester filling. The pillow is covered with lace fabric around the edges. You stated that the pillow will be either heart, square or cross-shaped and the sizes may vary slightly but will be in the range of the enclosed sample. The submitted sample is heart shaped and measures approximately 6-1/2” x 7” at its widest point.

Please note that separate Federal Trade Commission marking requirements exist regarding country of origin, fiber content, and other information that must appear on many textile items. You should contact the Federal Trade Commission, Division of Enforcement, 6th and Pennsylvania Avenue, N.W., Washington, D.C., 20580, for information on the applicability of these requirements to this item.

The applicable subheading for the wedding ring pillow will be 6307.90.9989, Harmonized Tariff Schedule of the United States (HTS), which provides for other made up articles . . . Other. The rate of duty will be 7 percent ad valorem.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
