RE: The tariff classification of tapered steel poles from China.

Dear Mr. Goldberg:

In your letter dated May 10, 2001 on behalf of RLS Lighting, Inc., you requested a tariff classification ruling.

The product to be imported is a welded tapered steel pole that measures 7.54 inches in outside diameter on one end and 5.82 inches in outside diameter on the other end. The tapered poles are used to support lighting for large areas like sporting events, arenas, etc. They are also used to support traffic lights and traffic signs, transmission lines and power lines.

You suggest that these tapered steel poles are classifiable under Harmonized Tariff Schedule of the United States (HTS) subheading 7305.31.20, which provides for tapered pipes and tubes of steel principally used as parts of illuminating articles. The tapered poles you plan to import cannot be classified under this subheading because HTS heading 7305 provides for pipes and tubes of iron or steel that have an external diameter that exceeds 406.4 mm.

The applicable subheading for the welded tapered steel poles having diameters of 7.54 inches and 5.82 inches will be 7306.30.3000, HTS, which provides for other tubes, pipes and hollow profiles (for example, open seamed or welded, riveted or similarly closed), of iron or steel, other, welded, of circular cross section, of iron or nonalloy steel, having a wall thickness of 1.65 mm or more, tapered steel pipes and tubes principally used as parts of illuminating articles. The rate of duty will be 2.3 percent ad valorem.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
