RE: The tariff classification of gloves from Slovakia, China, or Pakistan.

Dear Mr. Filip:

In your letter dated April 26, 2001, you requested a classification ruling for products shipped from KLZM-TILIA s.r.o. Liptovsky Mikulas.

Nine samples were submitted for review. Please note that ruling requests are limited to five samples. Please limit future requests to that number. Actual samples of gloves must be reviewed in order to have a ruling letter issued on prospective imports. An Outline of our Ruling Request Program is enclosed for your reference.

To obtain information on importing, we would suggest you review the Customs Web site at www.customs.gov. At the Web site, click on the Import and Export Section, and then on the Information for the Infrequent Importer/Traveler Section which has a U.S. Import Requirement site.

Style 0002 is a seamless latex dish washing glove with a flock lining. You have indicated that the gloves will be marketed for general household use.

Style 3013 is a gunn-cut work glove made of pigskin leather with an unfinished cut bottom. The back of the glove is open from below the knuckle area to the wrist. A backside elastic strap keeps the glove in place on the wearer.

Style 3005 is a work glove with a complete palmside made of buff split leather. The backside and open cuff is made of a woven fabric.

Style 3018 is a gunn-cut work glove made of pigskin leather with an open wrist trimmed with leather. The glove has a knitted cotton lining.

Style 3007 is a reversible glove with an extra thumb. Buff split leather overlays on both the palm and backside cover the area from the wrist up to the fingertips, as well as most of the thumb. The wrist area is made of denim material which has an elastic strap which secures the extra thumb when not in use. Additionally, the glove has corduroy fabric fourchettes.

Style 3034 is a knitted cotton work glove that has a textured heavy latex dipped coating covering the majority of the palmside and the backside from the fingertips down to the knuckle area. The latex coating exceeds 50% of the weight of the knitted fabric. The glove features a flared woven fabric cuff.

Style 3035 is a knitted cotton work glove that has a latex dipped coating covering the complete palmside and the backside from the fingertips down to the knuckle area. The latex coating appears to weigh less then 50% of the weight of the knitted fabric. The glove features a ribbed knit cuff.

Style 1944 is a work glove constructed of a finely knit cotton fabric with a heavy latex coating. The latex coating exceeds 50% of the weight of the knitted fabric. The glove is approximately 12 inches in length and features a rough finish on the palmside.

Style 1941 is a work glove constructed of a finely knit cotton fabric with a heavy latex coating. The latex coating exceeds 50% of the weight of the knitted fabric. The glove is approximately 14 inches in length.

Please note that pursuant to section 141.113, Customs Regulations (19 C.F.R. §141.113) and the Textile Fiber Products Identification Act (15 U.S.C. 70), textile and apparel articles are required to be marked or labeled with 1) the fiber content, by percentage in descending order by weight, using generic terms, 2) the name of the country of origin of the goods, and 3) the name of the importer or distributor or his RN number.

The applicable subheading for style 0002 will be 4015.19.1050, Harmonized Tariff Schedule of the United States (HTS), which provides for Articles of apparel and clothing accessories (including gloves), for all purposes, of vulcanized rubber other than hard rubber: gloves: other: seamless . . . other. The rate of duty will be 3 percent ad valorem.

Articles classifiable under subheading 4015.19.1050, HTS, which are products of Slovakia are currently entitled to duty free treatment under the Generalized System of Preferences (GSP) upon compliance with all applicable regulations. The GSP, however, is subject to modification and periodic suspension, which may affect the status of your transaction at the time of entry for consumption or withdrawal from warehouse. To obtain current information on GSP, check the Customs Web site at www.customs.gov. At the Web site, click on "CEBB" and then search for the term "GSP".

The applicable subheading for style 3013 and 3005 will be 4203.29.3010, HTS, which provides for Articles of apparel and clothing, accessories, of leather or of composition leather: gloves, mittens and mitts: other: other: other: men's . . . not lined. The rate of duty will be 14 percent ad valorem.

The applicable subheading for styles 3018 and 3007 will be 4203.29.3020, HTS, which provides for Articles of apparel and clothing accessories, of leather or of composition leather: gloves, mittens and mitts: other: other: other: men’s . . . lined. The rate of duty will be 14 percent ad valorem.

The applicable subheading for styles 3034, 1944 and 1941 and will be 6116.10.6500, HTS, which provides for Gloves, mittens and mitts, knitted or crocheted: impregnated, coated or covered with plastics or rubber: other: without fourchettes: other. The rate of duty will be 9.1 percent ad valorem.

The applicable subheading for style 3035, if the latex coating weighs less then 50% of the weight of the knitted cotton fabric not including the cuff, will be 6116.10.5510, HTS, which provides for Gloves, mittens and mitts, knitted or crocheted: impregnated, coated or covered with plastics or rubber: other: without fourchettes: other: containing 50 percent or more by weight of cotton, man-made fibers or other textile fibers, or any combination thereof . . . subject to cotton restraints. The duty rate will be 13.4 percent ad valorem.

The applicable subheading for style 3035, if the latex coating weighs more then 50% of the weight of the knitted cotton fabric not including the cuff, will be 6116.10.6500, HTS, which provides for Gloves, mittens and mitts, knitted or crocheted: impregnated, coated or covered with plastics or rubber: other: without fourchettes: other. The rate of duty will be 9.1 percent ad valorem.

Style 3035 will fall within textile category designation 331 if the latex coating weighs less then 50% of the weight of the knitted cotton fabric not including the cuff. Based upon international textile trade agreements products of China and Pakistan within textile category designation 331 are subject to quota and the requirement of a visa.

The designated textile and apparel categories and their quota and visa status are the result of international agreements that are subject to frequent renegotiations and changes. To obtain the most current information, we suggest that you check, close to the time of shipment, the U.S. Customs Service Textile Status Report, an internal issuance of the U.S. Customs Service, which is available at the Customs Web site at www.customs.gov. In addition, the designated textile and apparel categories may be subdivided into parts. If so, visa and quota requirements applicable to the subject merchandise may be affected and should also be verified at the time of shipment.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
