RE: The tariff classification of five decorative trimmings, from India.

Dear Mr. Maher:

In your letter dated April 18, 2001, you requested a classification ruling.

Five representative samples were submitted which you identified as #’s 4, 9, 11, 18 and 23, respectively.

All of these materials consist of two or more woven narrow fabric pieces, of various designs, sewn together lengthwise. You write that these materials will be imported in 3 to 6 inch widths and a 1½-yard length. You further indicated, in a phone conversation with this office, that all qualities would have the top (long length) edge finished with a hem and the bottom (long) edge finished by hemming, a fringe or beads. The short ends may or may not be hemmed, which could vary during the production of the goods.

You further indicated that these lengths will be put up on a card or board, cellophane wrapped and sold as a retail unit in stores catering to home sewing consumers. The card will depict such uses as attaching as edgings to the bottom of jean legs or attaching to pillows as trimmings, etc.

Samples 4, 9 and 23 are made entirely of 100% viscose rayon man-made fibers. Sample 23 has strings of beads and bangles attached to one edge. Sample 9 has one long edge hemmed while the other long edge has a fringe selvage. Samples 11 and 18 consist of two pieces of fabric made of 100% viscose man-made fibers and one piece of denim fabric composed of 100% cotton. In addition, sample 11 has one long edge hemmed while the other side contains a fringe selvage. Sample 18 has two hemmed long edges.

The applicable subheading for the five edging materials will be 5808.90.0010, Harmonized Tariff Schedule of the United States (HTS), which provides for ornamental trimmings in the piece, without embroidery, other than knitted or crocheted, of cotton; of man-made fibers. The duty rate will be 5.1 percent ad valorem.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
