RE: The tariff classification of a “Snap-2-It” and a sunshade from Hong Kong.

Dear Mr. Collini:

In your letter dated January 18, 2001, on behalf of Big Bang Products, LLC, you requested a classification ruling. The samples are being returned.

The samples submitted are two “Snap-2-It,” item marked numbers 2A and 2B and a sunshade, marked item number 5. The two “Snap-2-It” are beach mats made of an exterior surface of terry cloth fabric and one of nylon woven fabric. Housed into the articles edges is a spring-type steel tubing which allows the articles to pop open by itself and be used as a beach mat. The articles feature an open pocket on one side which houses an inflatable plastic air pillow. When not in use they are coiled into a flat disc shape and stored in a nylon fabric zippered bag.

The sunshade is made of nylon woven fabric sewn over a spring metal flexible frame. Attached lengthwise onto the article is a nylon woven fabric strap with hook and loop fastener to secure the sunshade underneath the above beach mat. This strap when pulled together and held closed with the hook and loop fastener creates a dome shaped shelter that offers protection from the wind and the sun. It is secured into the sand, grass or concrete with an attached plastic anchor.

The applicable subheading for the sunshade and “Snap-2-It” when imported together and the sunshade when imported alone will be 6306.22.9030, Harmonized Tariff Schedule of the United States (HTS), which provides for tents: Of synthetic fibers: Other, other. The duty rate will be 9.2 percent ad valorem.

The applicable subheading for the “Snap-2-It” when imported separately will be 6307.90.9989, HTS, which provides for other made up articles . . . Other. The rate of duty will be 7 percent ad valorem.

Products classifiable under subheading 6306.22.9030, HTS, fall within textile category designation 669. Based upon international textile trade agreements products of Hong Kong are subject to quota and the requirement of a visa.

The designated textile and apparel categories and their quota and visa status are the result of international agreements that are subject to frequent renegotiations and changes. To obtain the most current information, we suggest that you check, close to the time of shipment, the U.S. Customs Service Textile Status Report, an internal issuance of the U.S. Customs Service, which is available at the Customs Web site at www.customs.gov. In addition, the designated textile and apparel categories may be subdivided into parts. If so, visa and quota requirements applicable to the subject merchandise may be affected and should also be verified at the time of shipment.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
