RE: The tariff classification of towels from Egypt.

Dear Mr. Elmeceery:

In your letter dated January 13, 2001 you requested a classification ruling.

You submitted samples of four towels. Three towels are made from 100 percent cotton terry toweling fabric. The dishtowel is made from 100 percent cotton jacquard woven fabric. All of the edges are hemmed and the towels are reversible. Article 1 is sheared on one side and the other has uncut loops. It measures approximately 41 x 68 inches and has a border. The towel and border feature a footprint design. Article 2 measures approximately 32.5 x 66 inches. It consists of terry and flat woven sections featuring a starfish and stripe design. Article 3 is a towel with a daisy design. One side is sheared and the other features uncut loops. It measures approximately 41 x 68 inches. Article 4 is a dishtowel that measures approximately 19.5 x 26.5 inches. The flat woven towel has a jacquard fruit design. You indicate that the towels, Article 1 to 3, will range in size from hand to beach towel and will also be available in a 13 x 13-inch washcloth size. As requested the samples are being returned.

The applicable subheading for Articles 1, 2 and 3 will be 6302.60.0020, Harmonized Tariff Schedule of the United States (HTS), which provides for bed linen, table linen, toilet linen and kitchen linen: toilet linen and kitchen linen, of terry toweling or similar terry fabrics, of cotton towels: other. The duty rate will be 9.5 percent ad valorem.

The applicable subheading for the towels if washcloth size (13 x 13 inches) will be 6302.60.0030, HTS, which provides for bed linen, table linen, toilet linen and kitchen linen: toilet linen and kitchen linen, of terry toweling or similar terry fabrics, of cotton other. The duty rate will be 9.5 percent ad valorem.

The applicable subheading for Article 4 will be 6302.91.0035, HTS, which provides for bed linen, table linen, toilet linen and kitchen linen: other: of cotton other: towels: jacquard figured. The duty rate will be 9.6 percent ad valorem.

Articles 1,2,3 and 4 fall within textile category designation 363. The washcloth falls within textile category designation 369. Based upon international textile trade agreements products of Egypt are subject to the requirement of a visa.

The designated textile and apparel categories and their quota and visa status are the result of international agreements that are subject to frequent renegotiations and changes. To obtain the most current information, we suggest that you check, close to the time of shipment, the U.S. Customs Service Textile Status Report, an internal issuance of the U.S. Customs Service, which is available at the Customs Web site at www.customs.gov. In addition, the designated textile and apparel categories may be subdivided into parts. If so, visa and quota requirements applicable to the subject merchandise may be affected and should also be verified at the time of shipment.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
