RE: The tariff classification of a wood photo frame, a cloth laundry bag on a wood stand, a wood plant stand, an iron hook on a wood block and door chimes from Pakistan

Dear Mr. Basrai:

In your letter dated December 7, 2000 you requested a tariff classification ruling.

The ruling was requested on several wood products from Pakistan. The products are a wood photo frame, a cloth laundry bag on a wood stand, a wood plant stand, an iron hook on a wood block and two hanging door chimes. Copies of photographs of the products were submitted.

The photo frame is listed as product # K-FM147. It consists of a wood frame that has been painted and decorated with screws and copper wire. The frame has a wood backing and a glass cover. The 4” by 7” frame rests on a wood easel.

Products # K-MN208 and # K-MN207 are door chimes consisting of decorated hanging strings with one or more brass bells. K-MN208 is 22” long and 1” wide and has four bells. K-MN207 is 20” long and .25” wide and has one bell. The strings are decorated with cloves, wood chips and yarn pom poms.

Product # K-MN808 is described as a wooden cloth laundry bag. It consists of a 31” long and 18” wide wood frame to which a cloth bag is attached. The frame is foldable and designed to stand on the floor when in use.

Product # K-WPS is described as a wooden plant stepper. It consists of a two-step stand stated to be 14.5” long by 11.5” wide by 12.5” high. It is made of wood and decoratively painted. It is designed to stand on the floor and to hold potted plants.

Product # K-MN183 is an iron hook attached to a shell shaped embossed and painted wood block. The product measures 5.25” long by 4.75” wide. It is designed to be mounted on a wall and used for hanging things. The essential character of the product is imparted by the iron hook because of the more important role the hook plays in the functioning of the product.

The applicable subheading for the wood photo frame (# K-FM147) will be 4414.00.0000, Harmonized Tariff Schedule of the United States Annotated (HTSUSA), which provides for wooden frames for paintings, photographs, mirrors or similar objects. The duty rate will be 3.9 percent ad valorem.

The applicable subheading for the door chimes (# K-MN208, # K-MN207) will be 8306.10.0000, HTSUSA, which provides for bells, gongs and the like, nonelectric, of base metal. The duty rate will be 5.8 percent ad valorem.

Articles classifiable under subheadings 4414.00.0000 and 8306.10.0000, HTSUSA, which are products of Pakistan are currently entitled to duty free treatment under the Generalized System of Preferences (GSP) upon compliance with all applicable regulations. The GSP, however, is subject to modification and periodic suspension, which may affect the status of your transaction at the time of entry for consumption or withdrawal from warehouse. To obtain current information on GSP, check the Customs Web site at www.customs.gov. At the Web site, click on "CEBB" and then search for the term "GSP".

The applicable subheading for the cloth laundry bag (# K-MN808) will be 9403.80.6040, HTSUSA, which provides for household furniture of other materials. The duty rate will be Free.

The applicable subheading for the plant stand (# K-WPS) will be 9403.60.8080, HTSUSA, which provides for other wooden furniture. The duty rate will be Free.

The applicable subheading for the iron hook on a wood block (# K-MN183) will be 8302.50.0000, HTSUSA, which provides for hat-racks, hat pegs, brackets and similar fixtures, of base metal. The duty rate will be Free.

The holding set forth above applies only to the specific factual situation and merchandise description as identified in the ruling request. This position is clearly set forth in 19 CFR 177.9(b)(1). This section states that a ruling letter is issued on the assumption that all of the information furnished in the ruling letter, either directly, by reference, or by implication, is accurate and complete in every material respect.

This ruling is being issued under the assumption that the subject goods, in their condition as imported into the United States, conform to the facts and the description as set forth both in the ruling request and in this ruling. In the event that the facts or merchandise are modified in any way, you should bring this to the attention of Customs and you should resubmit for a new ruling in accordance with 19 CFR 177.2. You should also be aware that the material facts described in the foregoing ruling may be subject to periodic verification by the Customs Service.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
