RE: The tariff classification of travel bags and a briefcase from China.

Dear Mr. Spraitzar:

In your letter dated November 21st, 2000, on behalf of Asics Tiger Corporation, you requested a classification ruling.

The samples submitted with your request consist of travel bags and a briefcase, each of which is manufactured of textile material of man-made fibers. Styles ZR 0175 are ZR 0180 are travel bags. The interior of each is unlined and contains a zippered pocket and plastic reinforcement for the bottom panel. The top opening of each secured by a full-width zippered closure. Two carry handles and an adjustable shoulder strap are permanently attached to each bag. Style ZR0184 is a drawstring bag made of nylon mesh and nylon fabric. The interior is unlined and consists of a single compartment with no additional features. A zippered pocket is located on the front exterior of the bag and a padded bottle holder, similar to a cup holder, is secured to the carry strap by means of a hook and loop closure. The bag and bottle holder are considered a set and are imported packed for retail sale. The bottle holder is classifiable under HTS subheading 6307.90.9989. The bag imparts the essential character. Style ZR 0181 is a padded briefcase that appears to be designed to hold a computer as well as business papers and documents. The interior consists of a central zippered compartment with pockets and an auxiliary, zippered accordion compartment with pockets. The case is secured by a front flap with tuck lock closures. An adjustable shoulder strap and carry handle are incorporated on the case.

The applicable subheading for ZR 0181 will be 4202.12.8030, Harmonized Tariff Schedule of the United States (HTS), which provides for attache cases, brief cases, school satchelsof man-made fibers. The duty rate will be 18.6% ad valorem.

The applicable subheading for ZR 0175, ZR 0180, and ZR 0184 will be 4202.92.3031, Harmonized Tariff Schedule of the United States (HTS), which provides for travel, sports, and similar bags, with outer surface of textile material, other, other, of man-made fibers, other. The duty rate will be 18.6% ad valorem.

Items classifiable under HTS subheadings 4202.12.8030, 4202.92.9060 and 4202.92.3031 fall within textile category designation 670. Based upon international textile trade agreements products of China are subject to quota and the requirement of a visa.

The designated textile and apparel categories and their quota and visa status are the result of international agreements that are subject to frequent renegotiations and changes. To obtain the most current information, we suggest that you check, close to the time of shipment, the U.S. Customs Service Textile Status Report, an internal issuance of the U.S. Customs Service, which is available at the Customs Web site at www.customs.gov. In addition, the designated textile and apparel categories may be subdivided into parts. If so, visa and quota requirements applicable to the subject merchandise may be affected and should also be verified at the time of shipment.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
