RE: The tariff classification of handbags from China.

Dear Mr. Giumentaro:

In your letter dated December 1st, 2000, on behalf of Bisadora LLC, you requested a classification ruling.

The samples submitted with your request are handbags. Each handbag is approximately a 5.25" square and has a spring steel device to open and close at the top. You state that the handbags will be sold with a zinc alloy chain belt that will be imported separately. The interior of each handbag is lined and consists of two compartments formed by a divider. A belt loop is sewn to the rear exterior of the handbag. Handbags identified as "Zenith Angel", "Leather Print", and "Rainbow Print" have an exterior surface of sheeting of Polyvinyl Chloride (PVC). "Denim" has an exterior surface of 100% cotton.

The applicable subheading for "Zenith Angel", "Leather Print", and "Rainbow Print" will be 4202.22.1500, Harmonized Tariff Schedule of the United States (HTS), which provides for handbagswith outer surface of sheeting of plastic. The duty rate will be 17.6% ad valorem.

The applicable subheading for "Denim" will be 4202.22.4500, Harmonized Tariff Schedule of the United States (HTS), which provides for handbagsof cotton. The duty rate will be 6.7% ad valorem.

Items classifiable under HTS subheading 4202.22.4500 fall within textile category designation 369. Based upon international textile trade agreements products of China are subject to quota and the requirement of a visa.

The applicable subheading for the zinc alloy chain belt will be 7907.00.6000, Harmonized Tariff Schedule of the United States (HTS), which provides for other articles of zincother. The duty rate will be 3% ad valorem.

The designated textile and apparel categories and their quota and visa status are the result of international agreements that are subject to frequent renegotiations and changes. To obtain the most current information, we suggest that you check, close to the time of shipment, the U.S. Customs Service Textile Status Report, an internal issuance of the U.S. Customs Service, which is available at the Customs Web site at www.customs.gov. In addition, the designated textile and apparel categories may be subdivided into parts. If so, visa and quota requirements applicable to the subject merchandise may be affected and should also be verified at the time of shipment.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
