RE: The tariff classification of a Game Shark® Pro video game enhancer, FlexiLight™ and link cable from England and China.

Dear Mr. Johnson:

In your letter dated November 6, 2000, you requested a tariff classification ruling, on behalf of Interact Company.

You are requesting the tariff classification on a product that consists of the Game Shark® Pro cartridge, the FlexiLight™ and the link cable. The Game Shark® Pro cartridge comes loaded with dozens of game-enhancing codes, while the FlexiLight™ allows the player to operate in low-light settings. The link cable enables another player to join in playing with the first player. The three items in the package are designed for use with the hand-held Game Boy® products. The Game Shark® Pro is manufactured in England and the FlexiLight™ and link cable are manufactured in China. The complete product is classified as accessories to hand-held game machines in the HTS.

The applicable subheading for the Game Shark® Pro cartridge, the FlexiLight™ and the link cable will be 9504.90.4000, Harmonized Tariff Schedule of the United States (HTS), which provides for “Other: Game machines, other than coin- or token operated; parts and accessories thereof.” The rate of duty will be free.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).

A copy of the ruling or the control number indicated above should be provided with the entry documents filed at the time this merchandise is imported. If you have any questions regarding the ruling, contact National Import Specialist Tom McKenna at 212-637-7015.
