RE: The tariff classification of a glove, knee and elbow pad set from China.

Dear Ms. Needham:

In your letter dated November 2, 2000, you requested a tariff classification ruling.

You are requesting the tariff classification on an item that is a protective pad set consisting of two half fingered gloves, two elbow pads and two knee pads. The enclosed literature on the product indicates that the set is made for youths while engaged in the following activities: in-line skating, skateboarding, bicycle riding and scooter riding. The product is considered a GRI 3 (b) set for the purposes of the HTS. The essential character of the set is imparted by the protective knee pads and elbow pads, and the entire set including the half fingered gloves are classified in Chapter 95 of the HTS, as equipment for general physical exercise.

The applicable subheading for the glove, knee and elbow pad set will be 9506.99.6080, Harmonized Tariff Schedule of the United States (HTS), which provides for “Articles and equipment for general physical exercise, gymnastics, athletics, other sports or outdoor games: Other: Other: Other.” The rate of duty will be 4 percent, ad valorem.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
