RE: The tariff classification of a “Super Dream Rider” and a “Soft Bed Rail” from China.

Dear Ms Castellanos:

In your letter dated September 26, 2000, on behalf of Tomy Corporation, you requested a tariff classification ruling.

The submitted literatures depict a “Super Dream Rider, item number 8355 and a “Soft Bed Rail.” The “Super Dream Rider” is a baby carrier designed to carry a baby on a person’s back. It is constructed using nylon woven fabric, foam padding and textile straps mounted onto a metal frame. It features a storage compartment with a zipper closure.

The “Soft Bed Rail” is made of a metal frame covered with textile fabric. It is mounted between the mattress and box spring to safeguard children from rolling off the bed.

The applicable subheading for the “Super Dream Rider” will be 6307.90.9989, Harmonized Tariff Schedule of the United States (HTS), which provides for other made up articles . . . Other. The rate of duty will be 7 percent ad valorem.

The applicable subheading for the “Soft Bed Rail” will be 9403.90.8040, HTS, which provides for other furniture and parts thereof: Parts: Other: Other, of metal. The rate of duty will be free.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
