RE: The tariff classification of Chargers for Cell Phone Batteries from China & Korea

Dear Mr. Weiser:

In your letter dated August 3, 2000, you requested a tariff classification ruling.

The merchandise is described in your letter as Chargers for Cell Phone Batteries (Models TC20, CLC220 and DTC850). They are described as follows:

1.) Model TC20 – is a travel charger for STA cellular telephone batteries. It incorporates an output plug specifically sized, shaped and configured to fit into the corresponding receptacle of an STA cell phone for the purpose of charging an STA cell phone battery. The input is 120V AC and the output is 4.2V DC.

2.) Model CLC220 – is a cigarette lighter adapter that is designed to charge STA cellular telephone batteries while traveling in an automobile. The cigarette lighter adapter incorporates an output plug specifically sized, shaped and configured to fit into the corresponding receptacle of an STA cell phone for the purpose of charging an STA cell phone battery. The input of the charger is 12V and output is in the range of 4.22 to 4.49V DC.

3.) Model DTC850 - is a desktop rapid charger for STA cellular telephone batteries. It incorporates two charging slots to permit the charging of two cell phone batteries simultaneously. The input of the charger is 100-240V AC and the output is 4.2V DC.

A sample of each Model Charger was submitted to this office.

The applicable subheading for the Chargers for Cell Phone Batteries will be 8504.40.8500, Harmonized Tariff Schedule of the United States (HTS), which provides for “Electrical transformers, static converters (for example, rectifiers) and inductorsFor telecommunication apparatus”. The rate of duty will be free.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
