RE: The tariff classification of a woman’s sweater and tank top from Taiwan

Dear Maher:

In your letter dated August 23, 2000, on behalf of Design Network, Inc., you requested a tariff classification ruling.

The submitted sample, style 5048, is a woman’s knit openwork sweater (100% mohair) and a knit sleeveless tank top (100% polyester) that is not permanently attached at the shoulders of the sweater. The outer garment, the sweater, features a round neckline and long sleeves. The neckline, sleeves and the bottom of the garment are finished with ribbed fabric. The inner garment, the tank-top, features a scoop front and back, 2 inch shoulder straps, and a hemmed bottom.

Your sample is being returned as requested.

The applicable subheading for style 5048, the sweater, will be 6110.10.2030, Harmonized Tariff Schedule of the United States (HTS), which provides for women’s sweaters, knitted: of wool or fine animal hair: other. The duty rate will be 16.4% ad valorem. The applicable subheading for style 5048, the tank-top, will be 6109.90.1065, which provides for women’s tank-tops, knitted: of other textile materials: of man-made fibers. The duty rate will be 32.8% ad valorem.

The sweater falls within textile category designation 446. The tank-top falls in category 639. Based upon international textile trade agreements products of Taiwan are subject to quota and the requirement of a visa.

The designated textile and apparel categories and their quota and visa status are the result of international agreements that are subject to frequent renegotiations and changes. To obtain the most current information, we suggest that you check, close to the time of shipment, the U.S. Customs Service Textile Status Report, an internal issuance of the U.S. Customs Service, which is available at the Customs Web site at www.customs.gov. In addition, the designated textile and apparel categories may be subdivided into parts. If so, visa and quota requirements applicable to the subject merchandise may be affected and should also be verified at the time of shipment.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
