RE: The tariff classification of cleaning cloths and dishcloths from Pakistan.

Dear Ms. Jacobs:

In your letter dated July 28, 2000 you requested a classification ruling on behalf of Fieldcrest Cannon, Inc.

The submitted sample, identified as an “18 pack Household Utility Set”, consists of dust cloths and dishcloths. The dust cloths are made from 100 percent cotton woven flannel fabric. The tan colored cloths measure 13 x 18 inches. All four edges are finished with an overlock stitch. The dishcloths will be made in three versions. Type 1 and 2 are made from 100 percent cotton woven fabric. Type 1 features a complex weave with a checkered pattern and type 2 has a waffle weave with a checkered pattern. The edges are finished with a overcast stitch. Type 3 is comprised of two layers of fabric sewn along the edges with an overcast stitch. One layer is made from 100 percent cotton woven fabric. This layer features a waffle weave construction with a checkered pattern. The second layer is a knit mesh fabric made from polyester. All of the dishcloths measure 12 x 13. As requested the samples are being returned.

The applicable subheading for the dust cloths will be 6307.10.1090, Harmonized Tariff Schedule of the United States (HTS), which provides for other made up articles, including dress patterns: floorcloths, dishcloths, dusters and similar cleaning cloths: dustcloths, mop cloths and polishing cloths, of cotton other. The duty rate will be 4.3 percent ad valorem.

The applicable subheading for the dishcloths will be 6307.10.2027, HTS, which provides for other made up articles, including dress patterns: floorcloths, dishcloths, dusters and similar cleaning cloths: other dish cloths: of cotton. The duty rate will be 7.4 percent ad valorem.

The dust cloths and dishcloths fall within textile category designation 369. Currently items from Pakistan which fall under categories 369-0 are not subject to the requirement of quota or a visa.

The designated textile and apparel categories and their quota and visa status are the result of international agreements that are subject to frequent renegotiations and changes. To obtain the most current information, we suggest that you check, close to the time of shipment, the U.S. Customs Service Textile Status Report, an internal issuance of the U.S. Customs Service, which is available at the Customs Web site at www.customs.gov. In addition, the designated textile and apparel categories may be subdivided into parts. If so, visa and quota requirements applicable to the subject merchandise may be affected and should also be verified at the time of shipment.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
