RE: The tariff classification of plastic musical Christmas door bells from China.

Dear Mr. Hoffacker:

In your letter dated July 6, 2000, on behalf of your client Consolidated Stores, Inc., you requested a tariff classification ruling.

The submitted literature depicts two plastic Christmas door bells. They are both identified as item #132-27252-256. One design features a snowman standing in front of a decorated Christmas tree with a house in the background. The other design is similar with Santa and his bag of gifts standing in front of the decorated Christmas tree.

Santa and snowman door bells require 3 “AA” size batteries (batteries are included). They also feature blinking lights and play 18 Christmas songs. The door bells measure 8-1/2 inches by 4-1/4 inch. They are packaged on a blister card.

The applicable subheading for the battery operated, musical Christmas door bells will be 9505.10.2500, Harmonized Tariff Schedule of the United States (HTS), which provides for articles for Christmas festivities and parts and accessories thereof: Christmas ornaments: other, other. The rate of duty will be free.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
