RE: The tariff classification of a boy’s two-piece playsuit from China

Dear Mr. Armani:

In your letter dated May 23, 2000, you requested a tariff classification ruling.

Style 005 is a two-piece playsuit consisting of a knit pullover and woven pants. The sleeveless pullover is made from a fine knit fabric that you state is 65% cotton and 35% polyester. The body of this pullover is pieced. It has a rib knit v-neckline, armholes finished with rib knit capping and a hemmed bottom. There are four contrasting color buttons located at the waistline of the pullover, two in front and two in back, positioned on each side of the garment center.

The pants are made from a woven fabric that you state is 95% cotton and 5% spandex. These pants have a zippered fly front opening and a one-button closure at the waist. The waistband is straight, without any elastic or belt loops. However, there are four buttonholes on the waistband, two in front and two in back, also positioned on each side of the garment center so that the pullover and pants can be joined together. There is a buttoned down cargo pocket located on each lower leg at the outside seam. There is a decorative overlay across the pullover front and on the pants pockets. An identical applique is present on each item.

You have indicated in your letter that this playsuit will have a descriptive hangtag visible to the consumer with a sketch stating “2 pc playsuit with reinforced 4 button/button hole attachments.” You also have indicated that this style will be imported in boys’ sizes 2T-4T and 4-7.

The applicable subheading for the pullover top will be 6110.20.2005, Harmonized Tariff Schedule of the United States (HTS), which provides for Sweaters, pullovers, sweatshirts, waistcoats (vests) and similar articles, knitted or crocheted: Of cotton: Other: Boys’ or girls’ garments imported as parts of playsuits. The rate of duty will be 18.2 percent ad valorem.

The applicable subheading for the pants will be 6203.42.4040, HTS, which provides for Men’s or boys’trousers, bib and brace overalls, breeches and shorts: Of cotton: Other: Trousers and breeches: Other: Imported as parts of playsuits. The rate of duty will be 17 percent ad valorem.

The pullover and pants fall within textile category designation 237. Based upon international textile trade agreements, products of China are subject to quota and the requirement of a visa.

The designated textile and apparel categories and their quota and visa status are the result of international agreements that are subject to frequent renegotiations and changes. To obtain the most current information, we suggest that you check, close to the time of shipment, the U.S. Customs Service Textile Status Report, an internal issuance of the U.S. Customs Service, which is available at the Customs Web Site at WWW.CUSTOMS.GOV. In addition, the designated textile and apparel categories may be subdivided into parts. If so, visa and quota requirements applicable to the subject merchandise may be affected and should also be verified at the time of shipment.

In accordance with your request, your sample will be returned to you under separate cover.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).

A copy of the ruling or the control number indicated above should be provided with the entry documents filed at the time this merchandise is imported.
